loft issue with 3d spline

Hi community,
I am trying to loft between a circle and an eclipse using a 3d spline as a guide. the feature wouldn't solve because "all guides should intersect each profile boundary". but i believe both ends of the guide do intersect the profiles.
I also notice that the center of the eclipse is a black dot while the center of the circle is white. does anyone know what the colors indicate?

The white dot versus the black dot:
White dot is a sketched "Point"
while the black dots are "End points" or "Center points" of other sketch geometry. In this case, the black dot was the center point of the ellipse, and the white dot was a sketched point that was placed on top of the circle's center point. (I just deleted this point by window selecting and deleting in sketch 16, as it was not being used)
You had a Plane 13 defined as an offset from the front plane.
This will not be as accurate as Plane-Point. because of tolerances.
once you fix that,
then make sure you are following the "path" instead of "guides and continuity"
also add some section counts to help smooth out the loft
